DATENSCHUTZERKLÄRUNG/ -VEREINBARUNG
Diese Erklärung beschreibt, wie Team
Pramhas s.r.o , 821 07 Bratislava, Platanova 13238/22 („wir“) Ihre personenbezogenen Daten
verarbeitet. Die Erklärung richtet sich an unsere Kunden, Interessenten und
potentielle zukünftige Kunden, sowie ihre jeweiligen Gesellschafter, Organe und
sonstigen Mitarbeiter.
Die Team Pramhas s.r.o., hat geeignete
technische und organisatorische Maßnahmen implementiert, die sicherstellen,
dass kein unberechtigter Zugriff auf die (sowie keine widerrechtliche
Verarbeitung der) zur Verfügung gestellten personenbezogenen Daten erfolgt. Die
technischen und organisatorischen Maßnahmen umfassen insbesondere ein
Zugriffsberechtigungskonzept, ein Datensicherungskonzept sowie physische und
digitale Schutzmaßnahmen betreffend unsere IT-Infrastruktur.

Zwecke der Datenverarbeitung
Wir
werden Ihre personenbezogenen Daten zu folgenden Zwecken verarbeiten:
o
zur Begründung, Verwaltung und Abwicklung der
Geschäftsbeziehung;
o
zur Stärkung der bestehenden Kundenbeziehung
bzw. zum Aufbau neuer Kundenbeziehungen oder dem Herantreten an Interessenten,
einschließlich der Information über aktuelle
Rechtsentwicklungen und unser Dienstleistungsangebot (Marketing);
und im Falle einer bereits erfolgten
Beauftragung:
o
zur Erfüllung unseres Auftrages im Rahmen
unseres Dienstleistungsangebots,
dies umfasst insbesondere aber nicht ausschließlich:
o
Linguistische Dienstleistungen;
o
Beratung in betriebswirtschaftlichen,
organisatorischen und wirtschaftlichen Bereichen;
o
Allgemeine Beratungsdienste (z.B.:
Behördenkommunikation, Behördengänge, Auskünfte von Versicherungen, …)
Soweit
wir Ihre personenbezogenen Daten bei Ihnen selbst erheben, ist die
Bereitstellung Ihrer Daten grundsätzlich freiwillig. Allerdings können wir
unseren Auftrag nicht oder nicht vollständig erfüllen, wenn Sie Ihre
personenbezogenen Daten nicht bereitstellen.
2.
Rechtsgrundlagen der Verarbeitung
Wir verarbeiten Ihre
personenbezogenen Daten, weil dies erforderlich ist, um den mit Ihnen
vereinbarten Auftrag zu erfüllen (Art. 6 Abs. 1 lit. b DSGVO) und zum Zwecke
der Erfüllung diverser gesetzlicher Verpflichtungen.
Im Übrigen verarbeiten
wir Ihre personenbezogenen Daten auf der Grundlage unseres überwiegenden
berechtigten Interesses, die unter Punkt 1 genannten Zwecke zu erreichen (Art.
6 Abs. 1 lit. f DSGVO) und auf der gesetzlichen Grundlage des Art. 9 Abs. 2
lit. g DSGVO.
3.
Übermittlung Ihrer personenbezogenen Daten
Ihre personenbezogenen Daten werden zum Zwecke der
Erweiterung des Dienstleistungsangebotes an folgenden Empfänger übermittelt:
o Mag. Andrea Pramhas, MBA, Gewerbliche Vermögensberaterin
Soweit dies zu den unter Punkt 1 genannten Zwecken zwingend
erforderlich ist, werden wir Ihre personenbezogenen Daten an folgende Empfänger
übermitteln:
o von uns eingesetzte
IT-Dienstleister sowie sonstige Dienstleister für Marketing- Aktivitäten,
o
Wirtschaftstreuhänder/Steuerberater für Zwecke der Finanzbuchhaltung,
o Kooperationspartner
und für uns tätige Rechtsvertreter
o vom Kunden bestimmte
sonstige Empfänger (z.B. Behörden, Versicherungen, ..),
Manche der oben genannten
Empfänger können sich außerhalb der Slowakei befinden oder Ihre
personenbezogenen Daten außerhalb der Slowakei verarbeiten. Das
Datenschutzniveau in anderen Ländern entspricht unter Umständen nicht jenem der
Slowakei. Wir setzen daher Maßnahmen, um zu gewährleisten, dass alle Empfänger
ein angemessenes Datenschutzniveau bieten.
4. Speicherdauer
Wir speichern Ihre
personenbezogenen Daten grundsätzlich bis zur Beendigung der Geschäftsbeziehung
im Rahmen derer wir Ihre Daten erhoben haben oder bis zum Ablauf der
anwendbaren gesetzlichen Verjährungs- und Aufbewahrungsfristen; darüber hinaus
bis zur Beendigung von allfälligen Rechtsstreitigkeiten, bei denen die Daten
als Beweis benötigt werden. Soweit Sie ein Kunde, ehemaliger Kunde, Interessent
bzw. potentiell zukünftiger Kunde oder eine Kontaktperson bei einer der
Vorgenannten sind, speichern wir Ihre personenbezogenen Daten für die Zwecke
des Marketings bis zu Ihrem Widerspruch oder dem Widerruf Ihrer Einwilligung,
soweit die Marketingmaßnahme auf Grundlage Ihrer Einwilligung erfolgt.
5. Ihre Rechte im Zusammenhang mit personenbezogenen Daten
Sie sind unter anderem
berechtigt (i) zu überprüfen, ob und welche personenbezogenen Daten wir über
Sie verarbeiten und Kopien dieser Daten zu erhalten, (ii) die Berichtigung,
Ergänzung, oder Löschung Ihrer personenbezogenen Daten zu verlangen, soweit
diese falsch sind oder nicht rechtskonform verarbeitet werden, (iii) von uns zu
verlangen, die Verarbeitung Ihrer personenbezogenen Daten einzuschränken, (iv)
unter bestimmten Umständen der Verarbeitung Ihrer personenbezogenen Daten zu
widersprechen oder die für die Verarbeitung zuvor gegebene Einwilligung zu
widerrufen, wobei ein Widerruf die Rechtsmäßigkeit der vor dem Widerruf
erfolgten Verarbeitung nicht berührt, (v) Daten-übertragbarkeit zu verlangen,
soweit Sie unser Kunde sind (vi) die Identität von Dritten, an welche Ihre
personenbezogenen Daten übermittelt werden, zu kennen und (vii) bei der
Datenschutzbehörde Beschwerde zu erheben.
Im Falle einer
Verletzung des Schutzes personenbezogener Daten (Data Breach) wird jene
Vertragspartei, welche diesen Datenschutzvorfall verursacht oder zu
verantworten hat, die Entscheidung über eine allfällige Meldung an den
Betroffenen und/oder die Datenschutzbehörde treffen.
Für die Löschungen von
personenbezogenen Daten sind, sowohl der Auftraggeber als auch die Team Pramhas
s.r.o, jeweils für den eigenen
Verantwortungsbereich verantwortlich.

VYHLÁSENIE/DOHODA O OCHRANE OSOBNÝCH ÚDAJOV
Toto
vyhlásenie popisuje, ako spracúva spoločnosť Team Pramhas s.r.o., 821
07 Bratislava, Platanova 13238/22 („my“) Vaše osobné údaje. Vyhlásenie je
určené pre našich zákazníkov, záujemcov a potenciálnych budúcich
zákazníkov, ako aj pre ich spoločníkov, orgány a ďalších zamestnancov.
Spoločnosť
Team Pramhas s.r.o., prijala primerané technické a organizačné opatrenia,
aby zabránila neoprávnenému prístupu k poskytnutým osobným údajom (ako
protiprávnemu spracúvaniu). Technické a organizačné opatrenia
zahŕňajú najmä koncepciu oprávneného prístupu, koncepciu ochrany
údajov, ako aj fyzické a digitálne ochranné opatrenia týkajúce sa našej IT
infraštruktúry.

Účely spracúvania údajov
Vaše osobné údaje spracúvame na tieto
účely:
o na
zriadenie, správu a realizáciu obchodného vzťahu;
o na
zlepšenie existujúceho vzťahu so zákazníkmi, príp. na nadviazanie nových
vzťahov so zákazníkmi alebo na oslovenie záujemcov, vrátane zlepšenia
poskytovania informácií o súčasnom
legislatívnom vývoji a o ponuke našich
služieb (marketing);
a v prípade už udeleného poverenia:
o
na plnenie našej
objednávky v rámci ponuky našich služieb, čo zahŕňa najmä, ale
nie výlučne:
o Jazykové
služby;
o Poradenstvo
v oblasti podnikania, organizácie a hospodárstva;
o Všeobecné
poradenské služby (napr. Komunikácia s úradmi, vybavovanie úradných
záležitostí, informácie z poisťovní, ...)
Pokiaľ zhromažďujeme Vaše
osobné údaje priamo od Vás, tak je poskytovanie Vašich údajov vždy
dobrovoľné. Ak nám však svoje osobné údaje neposkytnete, tak objednávku
nebudeme vedieť splniť alebo ju nebudeme vedieť splniť v
plnom rozsahu.
2. Právny základ spracúvania
Vaše
osobné údaje spracúvame, pretože je to nevyhnutné na splnenie objednávky, ktorú
sme s Vami uzavreli (článok 6 ods. 1 písm. b GDPR), a na účely
plnenia rôznych právnych záväzkov.
Okrem
toho spracúvame Vaše osobné údaje na základe nášho prevažujúceho oprávneného
záujmu týkajúceho sa splnenia účelov uvedených v bode 1 (článok
6 ods. 1 písm. f GDPR) a na právnom základe článku 9 ods. 2 písm. g GDPR.
3. Prenos Vašich osobných údajov
Vaše osobné údaje budú
odoslané nasledujúcim príjemcom s cieľom rozšíriť ponuku služieb:
o Mag.
Andrea Pramhas, MBA, profesionálny majetkový poradca
Ak to
bude nevyhnutné na splnenie účelov uvedených v bode 1, poskytneme Vaše
osobné údaje týmto príjemcom:
o poskytovateľom IT služieb, ktorých využívame,
ako aj iným poskytovateľom marketingových služieb,
o audítorom/daňovým poradcom na účely
finančného účtovníctva,
o spolupracujúcim partnerom a právnym zástupcom,
ktorých služby využívame
o iným príjemcom, ktorých určil zákazník (napr.
úrady, poisťovne, ...),
Niektorí z uvedených príjemcov sa môžu nachádzať
mimo územia Slovenska alebo môžu spracúvať Vaše osobné údaje mimo územia
Slovenska. Úroveň ochrany osobných údajov v iných krajinách nemusí
byť totožná s úrovňou ochrany na Slovensku. Z tohto dôvodu prijímame
opatrenia na zabezpečenie toho, aby všetci príjemcovia poskytli primeranú
úroveň ochrany údajov.
4. Lehota na uchovávanie údajov
V zásade uchovávame Vaše osobné údaje až do
ukončenia obchodného vzťahu, v priebehu ktorého sme Vaše údaje
získali, alebo do uplynutia uplatniteľných zákonných premlčacích
lehôt a lehôt na uchovávanie údajov; okrem toho až do ukončenia
akýchkoľvek právnych sporov, počas ktorých sa údaje vyžadujú ako
dôkaz. Pokiaľ ste zákazníkom, bývalým zákazníkom, záujemcom, príp.
potenciálnym budúcim zákazníkom alebo kontaktnou osobou niektorého z vyššie
uvedených zákazníkov, uchovávame Vaše osobné údaje na účely marketingu
dovtedy, kým nepodáte námietku alebo nezrušíte svoj súhlas, pokiaľ sa
marketingové aktivity realizujú na základe Vášho súhlasu.
5. Vaše práva v
súvislosti s osobnými údajmi
Okrem iného ste oprávnený (i) skontrolovať,
či a ktoré Vaše osobné údaje spracúvame a ste oprávnený získať kópiu
týchto údajov, (ii) máte právo požiadať o opravu, doplnenie alebo
vymazanie Vašich osobných údajov, pokiaľ sú nesprávne alebo sa
nespracúvajú v súlade s právom, (iii) taktiež môžete od nás požadovať
obmedzenie spracúvania Vašich osobných údajov, (iv) za určitých okolností
namietať voči spracúvaniu Vašich osobných údajov alebo zrušiť
vopred udelený súhlas so spracúvaním, pričom podaním námietky nie je
dotknutá zákonnosť spracúvania pred podaním námietky, (v) ste oprávnený
požiadať o prenos dát, pokiaľ ste naším zákazníkom, (vi) poznať
totožnosť tretích strán, ktorým sú Vaše osobné údaje postúpené a (vii)
podať sťažnosť na úrad na ochranu osobných údajov.
V prípade porušenia ochrany osobných údajov (data
breach) rozhodne tá zmluvná strana, ktorá tento bezpečnostný incident
zapríčinila alebo je zaň zodpovedná, o jeho prípadnom nahlásení
dotknutej osobe a/alebo úradu na ochranu osobných údajov.
Za vymazanie osobných údajov je v rámci svojej oblasti
zodpovednosti zodpovedný zadávateľ, ako aj spoločnosť Team
Pramhas s.r.o..

PRIVACY POLICY / AGREEMENT
This agreement describes how Team Pramhas s.r.o, 821 07 Bratislava,
Platanova 13238/22 ("we") processes your personal data. The agreement
is addressed to our customers, prospects and potential future customers, as
well as their respective shareholders, bodies and other employees.
Team Pramhas s.r.o. has implemented appropriate technical and
organizational measures to ensure that no unauthorized access to the personal
data provided (as well as any misappropriation of) is made. The technical and
organizational measures include, in particular, an access authorization
concept, a data protection concept as well as physical and digital protection
measures regarding our IT infrastructure.

1. Purposes of data
processing
We will process your
personal data for the following use cases:
o
for the establishment,
administration and implementation of the business relationship;
o
to strengthen the
existing customer relationship or to establish new customer relationships or to
approach prospective customers, including the information on current legal developments and our range of services (marketing);
and in the case, that an assignment was already made:
o
to fulfil our task as
part of our range of services,
this includes but not limited to:
o
Linguistic
services;
o
Consulting in business,
organizational and economic fields;
o
General consulting
services (e.g.: communication with authorities, dealing with authorities,
insurance information, ...)
If we collect your
personal data from you, the provision of your data is always voluntary.
However, we cannot or not completely fulfil our task if you do not provide your
personal information.
2. Legal basis of processing
We process your personal data because this is
necessary in order to fulfil the task agreed with you (art. 6 para. 1 lit. b
GDPR) and for the purpose of fulfilling various legal obligations.
In addition, we process your personal data on the
basis of our predominant legitimate interest to achieve the purposes mentioned
under point 1 (art. 6 para. 1 lit. f GDPR) and on the legal basis of Art. 9
para. 2 lit. g GDPR.

Transmission of your personal data
Your
personal data will be transmitted to the following recipients for the purpose
of expanding the range of services:

If it is
absolutely necessary for the purposes stated under point 1, we will forward
your personal data to the following recipients:
o IT service providers used by us as well as other
service providers for marketing purposes,
o Chartered accountant/tax consultant for financial
bookkeeping purposes,
o Cooperation partners and legal representatives
working for us
o Other recipients designated by the client (e.g.
authorities, insurance companies, ...),
Some of the recipients mentioned above may be outside
of Slovakia or may process your personal information outside of Slovakia. The
level of data protection in other countries may not necessarily be the same as
that of Slovakia. Therefore, we take steps to ensure that all recipients
provide an adequate level of data protection.
4. Storage period
Generally, we store your personal data until the
termination of the business relationship in the course of which we have
collected your data or until expiry of the applicable statutory limitation and
retention periods; in addition, until the termination of any legal disputes in
which the data is required as proof. Insofar as you are a customer, former
customer, prospective customer or potential customer or contact person of one
of the afore mentioned persons, we store your personal data for the purpose of
marketing until you object or revoke your consent, as far as you have consented
to the marketing measure.
5.
Your rights regarding personal data
You may, among other things (i), verify whether and
which personal information we process about you and obtain copies of such data,
(ii) to request the correction, addition, or deletion of your personal data, as
far as they are incorrect or non-compliant, (iii) to require us to restrict the
processing of your personal data, (iv) in certain circumstances, to object to
the processing of your personal data or to revoke the prior consent for processing.
This revocation does not affect the legality of the processing prior to the
revocation. (v) You may require data transferability as far as you are our
customer (vi) to know the identity of third parties to whom your personal
information is transmitted and (vii) to lodge a complaint with the Data
Protection Authority.
In case of breach of the protection of personal data
(Data Breach), the party that caused or is responsible for this data protection
incident, decides on a possible report to the affected person and/or the data
protection authority.
For the deletion of personal data, both the client and
Team Pramhas s.r.o are responsible for their own area of responsibility.
